These terms and conditions establish the contractual terms governing the commercial relationship between the client, hereinafter the “Client”, and the service provider, hereinafter the “Organiser”.
Ophélie TORRES, a sole trader operating under the trading name Ophélie TORRES, whose address is 315 chemin du Trial, 34160 Saint-Drézéry, and registered under SIRET number 75347418800046.
The Organiser presents her services on the website available at https://ophelietorres.com/, hereinafter the “Website”.
Preamble
The Organiser presents her services on the Website. She organises private and business events in all forms and by all means. She has an established structure, organisation, network and recognised experience in her field.
A contract between the Organiser and the Client is entered into following a discussion and the proposal of a quote and a service agreement.
In all cases, the services are available to any Client who is an adult, has the legal capacity to enter into a contract and act on their own behalf, and is able to use the chosen means of payment. Unless proved otherwise, the information recorded by the Organiser constitutes evidence of all transactions.
Article 1 — General provisions
These terms and conditions determine the Parties' rights and obligations in connection with the sale of the Organiser's services. The sale is made by signing a quote and/or a service agreement.
The Organiser reserves the right to amend these terms at any time by publishing a new version on her Website or by adding a new appendix to the quote. The applicable terms and conditions are those in force on the date of payment for the order, or the first payment where there are several, or on the date of the Client's signature. The Client keeps a copy of the terms and conditions with their quote or when placing their order.
The Organiser also ensures that acceptance is clear and unreserved. By signing the quote, the Client declares that they have read all these terms and conditions and, where applicable, any special terms of sale relating to a product or service, and accept them without restriction or reservation. The Client acknowledges having received the advice and information needed to ensure that the offer meets their needs.
If any provision of these terms and conditions is declared void, this does not invalidate the other provisions, which remain in force between the Parties. The clauses remain independent of one another. Any contractual amendment is valid only once agreed in writing and signed by the Parties.
If either Party does not invoke the other Party's breach of any obligation set out in these terms and conditions, this must not be interpreted as a future waiver of that obligation.
Article 2 — The Organiser's services
The Organiser offers several packages. To constitute a valid offer from the Organiser, these must be covered by a quote and/or a service agreement. These documents govern the Parties' collaboration. The packages are generally referred to as the “Services”, unless the Organiser specifies otherwise.
Any particular features of the Service provided to the Client will be included in the quote and/or service agreement. These Services cannot be ordered online through the Website.

- A 1-hour appointment.
- A personalised appointment.

Article 2.4. Partial wedding planning
You've started planning your wedding and would like help finding an important supplier, or you've realised you don't have time to manage everything and would prefer professional help with the tasks you still need to complete.
Article 3 — Entering into the contract
When the Client wishes to receive one of the Services described in these terms, a service agreement is submitted to them. Where these terms and conditions are provided in advance when the quote is signed, they are considered an appendix to the service agreement.
The Client may wish to hire or purchase equipment from the Organiser as part of a broader Service. In that case, if the order is not placed online, the hire or sale is governed by that service agreement.
Article 4 — Pricing and payment terms
Article 4.1. Prices
Prices are shown in euros (€) and no VAT applies, in accordance with Article 293 B of the French General Tax Code.
Article 4.2. Payment arrangements
The Organiser accepts payment by bank transfer or cheque. The Client may choose whichever of these payment methods suits them.
The payment arrangements, whether a payment schedule or payment in full, are specified in the service agreement signed by the Parties.
Article 4.3. The Organiser's travel expenses
The Client will reimburse the Organiser for travel and accommodation expenses incurred on all journeys made by her and her collaborators in connection with the sale, subject to supporting documents and provided the Client has approved these travel expenses in advance.
Amounts due for travel must be paid within 30 days of the Client receiving the expense statement.
Article 4.4. Consequences of non-payment
If the price is not paid in accordance with the arrangements specified on the Website or in the service agreement, the Organiser may, in addition to seeking performance of the relevant service through the courts, suspend the application of any guarantee and terminate the contracts concerned.
In all cases, the Organiser reserves the right to suspend performance of the Service or delivery temporarily until the Client's payments are brought up to date.
If the Client does not settle outstanding invoices, the Organiser reserves the right to begin any recovery proceedings needed to obtain payment of these sums. In that event, late-payment penalties at the statutory interest rate will apply. If the Client is a business, a fixed recovery charge of €40 (forty euros) will be added.
Article 5 — Withdrawal period
When the service agreement is signed, the arrangements for the right of withdrawal are stated to the Client in that document, which will bind them definitively.
Article 6 — Obligations and responsibilities of the Parties
The Parties' obligations and responsibilities are specified in the service agreement. In general:
- The Organiser is subject to an obligation of means (obligation de moyens) when providing the Services.
- She is responsible for her own actions, rather than those of third parties and other independent service providers with whom she may work.
- The Client is required to cooperate and to pay.
- The Client is responsible for their own actions and for use of the equipment during the event.
- The Organiser is deemed to provide a Service that complies with the regulations in force, these terms and the service agreement.
Article 7 — Client complaints
The Client may raise any complaint or problem by contacting the Organiser at the following postal address:
Ophélie Torres — Event & Wedding Planner
315 chemin du Trial
34160 Saint-Drézéry
Or by email at ophelietorres.pro@gmail.com.
Article 8 — Intellectual property rights
Trade marks, domain names, products, software, images, videos, text and, more generally, any information, creation or medium subject to intellectual property rights are and remain the Organiser's exclusive property. No intellectual property rights are transferred under these terms and conditions. Any full or partial reproduction, modification or use of these assets for any reason is strictly prohibited.
Article 9 — Force majeure and withholding performance
Any event beyond the Parties' control that qualifies as force majeure within the meaning of Article 1218 of the French Civil Code is considered a ground for exemption from their obligations and results in suspension of the sale. The event must prevent the Parties from performing their obligations in the manner normally provided for by these terms and conditions. The Parties will contact one another as soon as possible to agree new delivery arrangements.
If either Party fails to meet an obligation that is due, whether payment, performance of the service or cooperation, the other Party may in turn refuse to perform one of its obligations. This is permitted only if the failure is sufficiently serious and prevents the collaboration from continuing. The Party identifying the other Party's failure must notify it by registered letter with acknowledgement of receipt.
The Parties have 30 days to reach an agreement allowing the collaboration to resume. If the defaulting Party has not fulfilled its obligation by the end of that period, the sale will be terminated without any termination compensation.
Article 10 — Protection of personal data
To prepare a quote and meet the Client's various needs, the Client must provide certain personal data when contacting the Organiser: the surname, first name, email address, postal address and telephone number of the couple who are to marry.
The Organiser collects and processes this personal data solely to carry out her business and meet her obligations. The Client agrees to provide this data on the legal basis of the contract between them. The Organiser acts as the data controller.
At the end of the service, personal data is retained for 3 years.
In accordance with the law, the Client has various rights in relation to their personal data. At any time, they may request access or rectification, object to processing, withdraw consent, request data portability and object to any use of their data for direct marketing.
To exercise any of these rights, the Client must contact the Organiser at:
Ophélie Torres — Event & Wedding Planner
315 chemin du Trial
34160 Saint-Drézéry
Or by email at ophelietorres.pro@gmail.com. If the Client believes that the Organiser has not respected their rights, they may notify the CNIL (Commission Nationale de l’Informatique et des Libertés, the French data protection authority) by submitting a complaint as soon as they become aware of a possible infringement.
Article 11 — Applicable law and dispute resolution
Any consumer Client may contact the competent mediator for disputes arising from the Organiser's actions. The mediator may be contacted after the Parties have been in touch with one another to try to resolve the emerging dispute.
As a first step, the Client is invited to contact the Organiser at the following address:
Ophélie Torres — Event & Wedding Planner
315 chemin du Trial
34160 Saint-Drézéry
Or by email at ophelietorres.pro@gmail.com, describing the problem as precisely as possible.
If the Parties cannot reach an agreement, the Client may then contact the competent consumer mediator using the following contact details: Consumer mediation.
These terms and conditions and the transactions arising from them are governed by French law. They are written in French, and the French version takes precedence over any translated version.
If a dispute cannot be resolved amicably, the French courts will have jurisdiction under the ordinary rules of law.
